(A) It is unlawful for a person to knowingly do any of the following:

(1) Act as a hawker, peddler, canvasser and/or solicitor in the City of Goodyear without a current and valid permit issued by the City of Goodyear to do so;

(2) Improper use of the peddler permit;

(3) Falsely or fraudulently misrepresent the quantity, character or quality of any article offered for sale or service;

(4) Conduct door to door business between the hours of 8:00 p.m. and 9:00 a.m. Monday through Friday and between 5:00 p.m. and 11:00 a.m. Saturday and Sunday;

(5) Claim to be endorsed by the City of Goodyear solely based on the City having issued the permit;

(6) Remain on the property of another when requested to leave either orally or in written signage or other written form of notice; or

(7) Conduct business in a manner that a reasonable person would find obscene, threatening, intimidating or abusive; or

(8) Fail or refuse to display a valid peddler’s permit and official photo identification when requested by City or law enforcement personnel to do so.

(B) Violation of any provision of this article is a class 1 misdemeanor subject to any and all criminal and civil penalties and provisions provided in Articles 1-8 and 18-1 of the Goodyear City Code. Each violation is a separate and distinct offense and in case of a continuing violation, each day the violation continues shall constitute a separate offense, for which a separate penalty shall be assessed. In addition to all other criminal and civil penalties and provisions imposed, the permit issued pursuant to this article will be revoked. (Prior Code, § 8-1-6) (Am. Ord. 94-499, passed 5-10-1994; Am.
