For the purpose of this article, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

ONLINE LODGING MARKETPLACE. "ONLINE LODGING MARKETPLACE" means a person that provides a digital platform for compensation through which an unaffiliated third party offers to rent lodging accommodations in this state to an occupant, including a transient, as defined in A.R.S. § 42-5070 and the accommodations are not classified for property tax purposes under A.R.S. § 42-12002. For the purposes of this definition of an "Online lodging marketplace:"

(1) "LODGING ACCOMMODATIONS" means any space offered to the public for lodging, including any hotel, motel, inn, tourist home or house, dude ranch, resort, campground, studio or bachelor hotel, lodging house, rooming house, residential home, apartment house, dormitory, public or private club, mobile home or house trailer at a fixed location in this state or other similar structure or space.

(2) "UNAFFILIATED THIRD PARTY" means a person that is not owned or controlled, directly or indirectly, by the same interests.

SHORT-TERM RENTALS (“STRs”).

(1) Means any individually or collectively owned single-family or one-to-four-family house or dwelling unit, or any unit or group of units in a condominium or cooperative that is also a transient public lodging establishment or owner-occupied residential home offered for transient use if the accommodations are not classified for taxation under A.R.S. § 42-12001.

(2) Does not include a unit that is used for any nonresidential use, including retail, restaurant, banquet space, event center, or similar use.

TRANSIENT: has the same meaning as prescribed in detail in A.R.S. § 42-5070, and generally means any person who obtains the use of lodging space on a daily or weekly basis, or on any other basis for less than thirty consecutive days.

VERIFIED VIOLATION: means a finding of guilt for a criminal violation or a finding of responsibility for a civil violation for any state law or local ordinance/regulation relating to this Article 8-2 that has been finally adjudicated. (Ord. 22-1555, passed 9-12-2022)
