For purposes of this chapter the following definitions shall apply unless the context clearly indicates or requires a different meaning:

ALARM, ALARM SYSTEM OR ALARM DEVICE means any alarm, alarm system, device, or mechanism which, when activated, transmits a telephonic, wireless, electronic, video, or other form of message to an Alarm Business, or some other number, or emits an audible, visible or some other form of signal that may be heard, seen or detected by persons outside the protected premises, or transmits a signal beyond the premises in some other fashion, except those exempt as provided in this chapter. An Alarm System may consist of one or more components (e.g., motion detector, window breach detector, or similar components) all reporting to a central unit/system panel which, in turn, may be connected to or report to a Central Monitoring Station via telephonic, wireless, electronic, video, or other form of message.

ALARM BUSINESS means any person, business entity, or its representative or subcontractor engaged in the business of leasing, renting, maintaining, servicing, repairing, altering, connecting, replacing, installing, selling, moving, inspecting or monitoring any Alarm System or other related activity in the City. The foregoing sentence includes, but is not limited to, any person or business that derives any pecuniary benefit from any contract for the installation or monitoring of any Alarm System. This definition is intended to include all activities of Alarm System Installation, Alarm System Sales, Alarm System Repair Businesses and Alarm System Monitoring Businesses. This includes Alarm Businesses that are located both inside and outside the City of Goodyear. Neither the City of Goodyear nor the Police Department is an Alarm Business.

ALARM BUSINESS PERSONNEL means the employees, representatives, independent contractors, subcontractors, or any other person or business working on behalf of or for any Alarm Business, including but not limited to any person or business that derives any pecuniary benefit from any contract for the installation or monitoring of any Alarm System.

ALARM MONITORING BUSINESS/SERVICES; CENTRAL MONITORING STATION (“ALARM BUSINESS”) means any Person or business that intercepts or receives signals, regardless of form, indicating the activation of an Alarm System and relays this information to Public Safety Personnel. This includes all systems, which intercept, transmit or receive signals, regardless of form, from an Alarm installed within the City of Goodyear to any location inside or outside the City. For purposes of this chapter, any Central Monitoring Station acting on behalf of an Alarm Monitoring Company and/or any person responsible for Alarm Monitoring shall be considered an Alarm Monitoring Business.

ALARM SITE or ALARM PREMISE means any commercial or private premises or location which has and uses an Alarm System as provided by this chapter. Each tenancy, if served by a separate Alarm System in a multi-tenant building or complex, shall be considered a separate Alarm Site.

ALARM SYSTEM USER, ALARM USER means any Person who leases, rents, purchases, possesses, maintains, uses, controls or operates (or has the ability to operate) any monitored or proprietor Alarm System.

AUDIBLE ALARM means any device ar mechanism designed for the detection of an unauthorized entry on the premises and which, when activated, generates an audible sound on the premises.

AUTOMATIC DIALER means a device which is interconnected to a telephone line, cellular telephone service or radio link and is programmed to select a predetermined telephone number and transmit an emergency message indicating a need for emergency response either by voice methods or coded signals or by maintaining an open line with emergency services.

BURGLAR ALARM means any alarm other than a panic or duress alarm.

CENTRAL MONITORING STATION; ALARM MONITORING BUSINESS means any office, station or telephone answering service where persons monitor, receive, record, verify, validate and/or report emergency signals received from Alarm Systems.

CROSS ZONING means a way of configuring logic within the control panel such that two or more zones of the security system are interdependent to cause the alarm activation.

ENHANCED CALL VERIFICATION (“EVC”) means at least two calls to different telephone numbers are made by the Alarm Business (or its representative/subcontractor) to verify that an alarm signal is valid before requesting that public safety personnel respond to the alarm signal. For purposes of this ordinance, telephone and/or other verification shall require, at a minimum, that a second call be made to a different number if the first attempt fails to reach an alarm user or key holder who can properly identify themselves, to attempt to determine whether an alarm signal is valid before requesting law enforcement dispatch.

FALSE ALARM means any signal, message or other communication transmitted by an alarm system, person or other device which causes police or fire department response in which it is determined by the City not to be of an existing emergency or unlawful situation.

FIRE ALARM means a signal initiated by an Alarm System or portion of a combination system consisting of components and circuits arranged to monitor and annunciate the status of fire alarm or supervisory signal initiating devices and to initiate the appropriate response to those signals.

FIRE ALARM CONTROL UNIT (“PANEL”) means a system component that receives inputs from automatic and manual fire alarm devices and might supply power to detection devices and a transponder(s) or an off-premises transmitter(s). The control unit might also provide transfer of power to the notification appliances and transfer of condition to relays or devices connected to the control unit. The fire alarm control unit can be a local fire alarm control unit or master control unit.

PERSON, BUSINESS means an individual, corporation, firm, business trust, estate, trust, partnership, limited liability company, association, joint venture, or any other group, the legal or commercial entity, and its employee(s), representative(s) or subcontractor(s).

PUBLIC SAFETY PERSONNEL means any police, fire or medical personnel.

RESIDENTIAL ALARM means an alarm installed and used in any structure in which a person lawfully resides. All other Alarms are considered to be Non-Residential Alarms.

RESPONSIBLE PARTY or KEY HOLDER means any person(s) designated by the Alarm User to be responsible for responding to the premises of an alarm activation, who has the authority and ability to do all of the following: (1) to enter the premises/Alarm Site (possess a key or access card); (2) to set and deactivate the Alarm System; (3) to approve immediately necessary repairs to the Alarm System; (4) to allow access to the Alarm Site and the Alarm System; and (5) is capable of reaching the Alarm Site within 30 minutes of being contacted by the City or the Alarm Business.

ROBBERY, PANIC ALARM, DURESS ALARM means any system device, or mechanism, manually activated by an individual on or near the premises, to alert others that a robbery or any other crime is in progress, or that the user is in need of immediate assistance or aid in order to avoid injury or serious bodily harm, which is: (1) installed on real property; (2) designed to be manually activated by an individual for the purpose of summoning assistance to the premises; and (3) transmits a signal, regardless of form, that can be heard, seen or received by persons outside the protected premises.

TELECOMMUNICATIONS OPERATOR means a dispatcher for public safety personnel. (Ord. 12-1252, passed 2-13-2012)
