§ 12A-4-2 Wastewater discharge permit classifications.
(A) The Director is authorized to issue the following types of Industrial user Permits:
(1) Class I Permits shall be issued to Significant Industrial Users (SIUs).
(2) Class II Permits may be issued to High Strength Users who are not otherwise required to obtain a Permit. A High Strength User is one whose discharge of process wastewater contains an average of 135 pounds or more per discharge day of the sum of BOD, TSS and TN.
(3) Class III Permits may be issued to a Zero Process SIU or to a User meeting the definition of NSCIU in Section 12A-1-3.
(B) Any violation of the terms and conditions of an individual wastewater discharge permit shall be deemed a violation of this chapter and subjects the wastewater discharge permittee to the sanctions set out in this chapter. Obtaining an individual wastewater discharge permit does not relieve a permittee of its obligation to comply with all Federal and State Pretreatment Standards or Requirements or with any other requirements of Federal, State, and local law.
