(A) Any User meeting the definition of Significant Industrial User and/or potential to meet permit classifications per Section 12A-4-2 is required to apply for a Wastewater Discharge permit in compliance with City Code with an application fee set by resolution of council. The Director is responsible for issuing all permits.

(B) No person shall discharge or cause to be discharged any industrial wastewater directly or indirectly to the POTW without first obtaining Director approval. The Director shall set requirements at least as stringent as applicable state or federal rules, regulations or pretreatment standards.

(C) All Industrial Users discharging pursuant to this section shall comply with the following requirements:

(1) Comply with all applicable federal, state and local laws, rules, regulations and processes, including but not limited to the Act and the general pretreatment regulations (40 Code of Federal Regulations Part 403);

(2) Not introduce pollutants into the POTW that will interfere with its operation and the efficient functioning of the system;

(3) Conduct periodic maintenance of the User’s treatment and monitoring facilities to ensure that it is cleaned and functioning properly according to federal, state and local law, rules, and regulations;

(4) Take all necessary actions to prevent an overflow of sewage from the User’s treatment and monitoring facilities. Should an overflow occur, the User shall be responsible, at its sole expense, to clean and properly sanitize any area that could create a public health hazard; and

(5) Notify the IPP primary contact immediately by phone and at https://IPP.goodyearaz.gov if a sewage overflow enters the public right-of-way or the property of another.

(D) No Significant Industrial User shall discharge wastewater into the POTW without first obtaining a permit or form of authorization from the Director to discharge wastewater.

(E) The Director may require other Users to obtain wastewater discharge permits as necessary to carry out the purposes of this Chapter.

(F) Obtaining a wastewater discharge permit does not relieve a permittee of its obligation to comply with all federal and state Pretreatment Standards or Requirements or with any other requirements of federal, state, and local law.

(G) A separate permit may be required for each connection to the POTW. Any User required to obtain a wastewater discharge permit who proposes to begin or recommence discharging into the POTW shall obtain a new permit prior to the beginning or recommencing of such discharge.

(H) The Director may require a separate permit from each tenant as well as the owner or manager of any multi-tenant property, including, but not limited to: shopping centers, medical centers, and industrial or commercial parks.

(I) Any failure to complete the required questionnaire, apply for and obtain a required permit, or violate the terms and conditions of a wastewater discharge permit shall be deemed violations of this chapter and subject the User to enforcement actions pursuant to Section 12A-8.

(J) Any User planning to discharge non-domestic wastewater into the sewer system and POTW, shall first complete either an Industrial Pretreatment Questionnaire form (if they do not expect a permit is needed) or a permit application. Any User identified by the pretreatment program through the IPQ as needing a permit shall file a permit application. Applications for wastewater discharge permits, in accordance with this chapter, shall be filed at least 90 days prior to the desired date of discharge, and the discharge permit obtained prior to commencing discharge.
