§ 12A-4-11 Regulation of waste received from other jurisdictions.
(A) Before another municipality, User located within another municipality, or private utility contributes wastewater to the POTW they must enter into an agreement with the City, and comply with the provision of subsection (B) of this section.
(B) All agreements with any municipality, User located within another municipality, or private utility shall contain the following, along with such other provisions and information requested by the Director:
(1) Provide a description of the quality and volume of wastewater to be discharged to the POTW;
(2) A requirement for the contributing municipality, User located in another municipality, or private utility to adopt a sewer use ordinance which is at least as stringent as this chapter and Local Limits, including required Baseline Monitoring Reports (BMRs) which are at least as stringent as those provided in this chapter. The requirement shall specify that such chapter and limits must be revised as necessary to reflect changes made to the City’s ordinance or Local Limits;
(3) A requirement for the contributing municipality, User located within another municipality, or private utility to submit a revised User inventory on an annual basis or request from the Director and provide immediate access to the facilities of the Users identified on the inventory for the purposes of inspection, sampling and any duties deemed necessary by the Director;
(4) A provision specifying which pretreatment implementation activities, including wastewater discharge permit issuance, inspection and sampling, and enforcement, will be conducted by the contributing municipality, User located within another municipality, or private utility; which of these activities will be conducted by the Director; and which of these activities will be conducted jointly by the contributing municipality, User located within another municipality, or private utility and the Director;
(5) A requirement for the contributing municipality, User located within another municipality, or private utility to provide the Director with access to all information that the contributing municipality obtains as part of its pretreatment activities at no expense to the City;
(6) Limits on the nature, quality, and volume of the contributing municipality, User located within another municipality, or private utility’s wastewater at the point where it discharges to the POTW; and
(7) Requirements for monitoring the contributing municipality, User located within another municipality, or private utility discharge. (Ord. 14-1290, passed 3-3-2014; Am. Ord. 23-1584, passed 9-25-2023)
