(A) No permittee hereunder shall have any exclusive right to any location in a public street, nor shall the permittee be permitted to operate in any congested area where their operations might impede or inconvenience the public. For the purpose of this article, the judgement of a police officer or code compliance officer, exercised in good faith, shall be deemed conclusive as to whether the area is congested or the public is impeded or inconvenienced.

(B) It shall be the responsibility of the permittee to ensure that the City’s zoning regulations are complied with before applying for a business registration permit and during the term of the permit. The issuance of a permit shall not be deemed to validate the conduct of any business, activity, calling, vocation, profession, or trade at the address. (Ord. 04-902, passed 6-14-2004; Am. Ord. 06-1029, passed 10-10-2006)
