(A) After a Public Safety Sworn Employee Organization has been the Certified Public Safety Sworn Employee Organization for at least 12 months, any Eligible Employee in the Employee Group may request an election to Decertify the Public Safety Sworn Employee Organization by submitting a petition supported by the signatures of not less than 30% of Eligible Employees in the Employee Group. If the City Manager, through the City Clerk, verifies the petition, an election shall be conducted using the procedures above to determine whether the Public Safety Sworn Employee Organization will remain the Certified Public Safety Sworn Employee Organization for the Employee Group for the purpose of Meet and Discuss/Meet and Confer.

(B) In addition, Decertification can be declared at any time by the City Manager for violations of this article.

(C) A Public Safety Sworn Employee Organization seeking recognition as the representative of the Employee Group may be disqualified from the petition and/or election process at any time by the City Manager for violation of this article. (Ord. 11-1249, passed 10-24-2011)
