Whenever any words or phrases used in this article are not defined in this article but are defined in Title 28, Arizona Revised Statutes, as amended, such definitions shall apply to the words and phrases used herein.

ALLEY and ALLEYWAYS mean lanes or passageways for use as a means of access to the rear of lots or buildings.

C.F.R. means the Code of Federal Regulations.

CHIEF OF POLICE means the City of Goodyear Police Department Chief of Police or designee.

CITY means the City of Goodyear.

CITY MANAGER means the City Manager of the City of Goodyear or designee.

CITY TRAFFIC ENGINEER means the City of Goodyear Traffic Engineer or designee.

COMMERCIAL MOTOR VEHICLE and RECREATIONAL MOTOR VEHICLE mean any commercial motor vehicle as defined by Title 28, Arizona Revised Statutes, as amended, and all motorized and non-motorized tractors, trailers, semi-trailers, vans, trucks, open bed or flatbed pickups, mobile equipment, machinery, motor homes, campers, or other vehicles which meet one or more of the following criteria:

Vehicle or load height exceeds seven feet; or

Vehicle or load width exceeds seven and one-half feet, as measured from the widest portion of the vehicle or load, but not including mirrors; or

Vehicle or load length exceeds 20 feet (in combination with any attached trailers); or

A commercial motor vehicle containing hazardous material, hazardous waste or hazardous substances; or

Manufacturer’s gross vehicle weight rating exceeds 10,000 pounds; or

Any non-motorized vehicle regardless of its height, width, length or weight when it has been detached from a motor vehicle that is capable of towing such vehicle; or

Vehicles transporting hazardous materials and required to be placarded under 49 C.F.R. § 49.172, as amended, operators of such vehicles shall have in their possession at all times documentation verifying their deliveries or pick-ups.

CROSSWALK means that part of a roadway at an intersection included within the connections of the lateral lines of the sidewalks on opposite sides of the roadway, measured from the curbs, or in the absence of curbs, from the edge of the traversable roadway. Any portion of a roadway at an intersection or elsewhere distinctly indicated for pedestrian crossing by lines or other markings on the surface.

DRIVER means an occupant of a motor vehicle who is in actual physical control of that vehicle, or for an out of control vehicle, an occupant who was in control prior to losing control.

DRIVEWAY means every entrance or exit authorized pursuant to applicable law and used by vehicular traffic to or from lands or buildings abutting a roadway.

EMERGENCY VEHICLES means authorized emergency vehicles as defined by Title 28, Arizona Revised Statutes, as amended, including private ambulances, private escort vehicles of funeral and other processions, emergency vehicles of public service corporations, and such others as may be designated by the City Council. All traffic laws and ordinances are applicable to such emergency vehicles when they are not proceeding under an emergency situation.

FIRE CHIEF means the City of Goodyear Fire Department Fire Chief or designee.

FIRE LANE means any area within any public right-of-way, public or private easement, or public or private property designated by the City for fire trucks or other firefighting equipment.

HAZARDOUS MATERIALS means a substance identified in 49 C.F.R. § 172, as amended, to be capable of posing an unreasonable risk to health, safety and property if transported in commerce.

HAZARDOUS SUBSTANCE means a material and its mixtures or solutions that has been identified in 49 C.F.R. § 172, as amended, to be capable of posing an unreasonable risk to health, safety and property if transported in commerce.

HAZARDOUS WASTE means a material that is subject to the hazardous waste manifest requirements of the Department of Environmental Quality or the United States Environmental Protection Agency.

INTERSECTION means when two or more roadways cross or connect, the area contained within the extension of curb lines, or, if none, then the lateral roadway boundary lines. Driveway accesses are not classified as intersections.

MOTOR VEHICLE and VEHICLE mean any device in, upon or by which a person or property is or may be transported or drawn, including, but not limited to, a motor vehicle, trailer or semi-trailer of a type subject to registration under Title 28 of Arizona Revised Statutes as amended; including but not limited to commercial motor vehicles, recreational vehicles, off-road vehicles; all-terrain vehicles; off-road motorcycles; and watercraft of any kind.

OFFICIAL TRAFFIC CONTROL DEVICE means all signs, signals, parking meters, markings, and devices not inconsistent with this article, placed or erected by authority of the City for the purpose of regulating, warning or guiding traffic.

PARKED and PARKING mean the standing of a vehicle, whether occupied or not, other than temporarily for the purpose of and while actually engaged in loading or unloading property or passengers.

PERSON means any individual, enterprise, partnership, co-partnership, firm, company, corporation, association, trust, estate, governmental entity, municipality, state or federal agency or any other legal entity; or their legal representatives, property managers, agents, assigns, or employee thereof.

PUBLIC SAFETY PERSONNEL means law enforcement officers and/or fire fighters acting in their official capacity.

RECREATIONAL MOTOR VEHICLE – see the definition of COMMERCIAL MOTOR VEHICLE.

ROAD means the part of a trafficway which includes the roadway and the shoulder alongside the roadway.

ROADWAY means that portion of a road that is improved, designed or ordinarily used for vehicular travel, exclusive of the berm or shoulder.

SHOULDER means that portion of the road contiguous to the roadway for accommodation of stopped vehicles, for emergency use, and for lateral support of the roadway structure. The line between the roadway and the shoulder may be a painted edge line, a curb, or a change of surface color or material.

SIDEWALK means that portion of a street between the curb lines, or the lateral lines of a roadway, and the adjacent property lines, intended for use by pedestrians.

STAND and STANDING – see the definition of PARKED.

STREET means the entire width between the boundary lines of every way if a part of the way is open to the use of the public for purposes of vehicular travel.

TRAFFICWAY means any land way open to the public as a matter of right or custom for moving persons or property from one place to another.

TRAILER means any vehicle without motive power designed for carrying persons or property on its own structure and to be drawn by a vehicle with motor power. The term TRAILER includes trailer coach, semitrailer, boat trailer, or utility trailer.

TRAVEL TRAILER means a trailer built on a single chassis transportable upon the public streets and highways that is designed to be used as a temporary dwelling without a permanent foundation and may be used without being connected to utilities.
