(A) The Director may issue a Notice to Show Cause to a User which has violated, or continues to violate, any provision of this chapter; a wastewater discharge permit or compliance order; or any other pretreatment standard or requirement. A Notice to Show Cause meeting provides the User with the opportunity to present information to the Director about why a proposed enforcement action should not be taken. The notice will be served to the User specifying the time and place of the Show Cause meeting, the proposed enforcement action, the reasons for such action, and a request that the User show cause why the proposed enforcement action should not be taken.

(B) The notice will be served personally or by registered or certified mail (return receipt requested) at least 10 calendar days prior to the meeting. A Show Cause meeting will not be a bar against, or prerequisite for, taking any other action against the User. The User may waive the right for a Show Cause meeting.
