Information and data regarding a User obtained from reports, surveys, wastewater discharge permit applications, wastewater discharge permits, monitoring programs, and from the City’s inspection and sampling activities, shall be available to the public without restriction and are subject to release pursuant to public records requests. When obtaining a permit, it is the responsibility of the User to clearly identify in writing to the Director those items the User believes would qualify as a trade secret or propriety information. The City will use reasonable efforts to inform the User of public records requests, for information the User has previously identified in writing to the Director as data involving trade secrets or propriety information, prior to the City releasing that information. It will then be the responsibility of the User to seek a court order to preclude disclosure. The City will not be legally responsible for the disclosure of information pursuant to federal or state law. Trade secrets or secret processes shall be made available immediately upon request to governmental agencies for uses related to the NPDES program or pretreatment program and in enforcement proceedings involving the person furnishing the report. Wastewater constituents and characteristics and other "effluent data" as defined by 40 CFR 2.302 will not be recognized as confidential information and will be available to the public without restriction.
