(A) It is unlawful for a person, after being advised that the person’s refusal to answer is unlawful, to fail or refuse to provide identification or evidence of identity on request of a law enforcement officer who has lawfully detained the person based on reasonable suspicion that the person has committed, is committing or is about to commit a civil or criminal violation of an ordinance of the City or any law of the State of Arizona or the United States.

(B) Definitions. For purposes of this section:

(1) IDENTIFICATION means any legally issued government document that contains the person’s:

(a) facial photograph;

(b) true full name;

(c) date of birth;

(d) physical description, including, but not limited to, height, weight, eye color, sex, and hair color.

(2) EVIDENCE OF IDENTITY means that the person has provided the peace officer with the person’s true full name and date of birth upon request of a law enforcement officer.

(3) LAW ENFORCEMENT OFFICER means those persons responsible for the enforcement of the provisions of the Goodyear Municipal Code, including provisions related to fire, building, zoning, and life and safety codes; those individuals empowered to make arrests for offenses under the Goodyear Municipal Code; or those individuals responsible for the enforcement of federal or state criminal laws.

(4) A violation of this section is class one misdemeanor and subject to the penalty in Article 1-8 of this code. (Ord. 23-1585, passed 8-28-2023)
