(A) It is unlawful for any person to knowingly transport or cause to be transported any refuse, trash, garbage, debris, green waste, hazardous water or recycling on or along any trafficway in the City, other than bulk refuse, when City sanitation services are available, unless authorized by this chapter.

(B) Private Services. It is unlawful for any person to provide residential sanitation services, such as collecting, gathering, hauling or disposing of refuse, except as provided in this chapter.

(C) Spill Proof Vehicle. It is unlawful for any person to knowingly transport or cause to be transported on or along any trafficway in the City any refuse, debris, litter, garbage, green waste, hazardous waste or recycling material unless such refuse, debris, litter, garbage, green waste, hazardous waste or recycling is contained in strong, secure, watertight vehicles or vehicles with secure watertight receptacles constructed to prevent any such refuse, litter, garbage, green waste, hazardous waste or recycling material from falling, leaking or spilling and any odor from escaping.

(D) Spillage. It is unlawful for any person to knowingly transport or cause to be transported on or along any trafficway in the City any refuse, debris, litter, garbage, green waste, hazardous waste or recycling material in or on a vehicle from which any refuse, garbage, green waste, hazardous waste or recycling falls, leaks, spills or emits odor.

(E) It is unlawful to knowingly throw, deposit or cause to be deposited any refuse, debris, litter, garbage, green waste, hazardous waste or recycling material, regardless of form, upon any private or public property within the City. It is a defense if the responsible person has a valid current customer account and their action is specifically permitted in this chapter.

(F) All violations of this article are class 1 misdemeanors subject to the penalties provided in Article 1-8 and Chapter 18. All violations may be pursued both civilly and criminally.
