For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.

ANIMAL MANURE means waste resulting from farm animals (i.e., chickens, horses, pigs, and cows) or other nondomestic animals.

BUILDING MATERIALS. See "Construction Materials," "Building Materials."

BULK REFUSE means large refuse that cannot be placed inside a City issued refuse container with the lid of the container closed. Light metal pipe less than one inch in diameter, with no objects exceeding four feet in length, uncontained household appliances (e.g., washer, stove, refrigerator, water heater), household furniture (e.g., couches, chairs, patio furniture), brush, tree branches, palm fronds and other large items not exceeding four feet in length that will not fit into City provided containers. Bulk refuse does not include bagged household garbage not placed in City provided containers.

BUNDLED means items are grouped together such as tree limbs, branches or other items similar in nature, which are stacked parallel to one another and banded or fastened together by rope, twine, cord, or item similar in characteristic. Each individual bundle shall not exceed 50 lbs and four feet in length.

CITY means the City of Goodyear or designee, or any entity with which the City contracts to provide the specific service(s) identified in this chapter on behalf of the City.

CITY MANAGER means the City of Goodyear City Manager or designee.

COMMERCIAL ACCOUNT means an account for a profit or nonprofit business and multi-family residential dwelling units, excluding single family residences.

COMMERCIAL CONTAINER means any container, other than a City issued residential refuse and recycling container.

CONSTRUCTION MATERIALS, BUILDING MATERIALS means materials used in, from or related to construction, excavation, demolition, remodeling, or site preparation including, but not limited to, rocks, trees, debris, bricks, concrete, lumber, nails, plumbing materials, stone, shingles, drywall, wires, packaging, plaster, all types of scrap building materials or excavated materials. Construction and building materials are not picked up by the City.

CUSTOMER means the property owner or any person, renter, lessee, occupant, government agency, nonprofit or entity responsible for payment of utility service(s) provided by the City.

DANGEROUS REFUSE. See "Hazardous Waste, Dangerous Refuse."

DEBRIS means all forms of refuse, garbage, trash, litter, construction materials, hazardous waste, green waste, and any form of waste, refuse or recycling materials as defined in this chapter which is less than one foot in length.

DILAPIDATED means decayed, deteriorated, or fallen into partial ruin.

DIRECTOR means the person or his/her designee authorized by the City Manager to administer, implement and enforce the provisions of this chapter.

DOMESTIC ANIMAL REFUSE means refuse resulting from a pet, including but not limited to dogs, cats, birds or other tame animals traditionally found to reside inside a home or residential dwelling.

GARBAGE means all putrescible wastes (excluding sewage and body wastes), including all organic wastes which have been prepared for, or intended to be used as, food or resulted from the preparation of food, including all such substances from public and private establishments or residences.

GREEN WASTE means all tree limbs, branches, palm fronds, shrub trimmings, grass clippings and other landscape debris. Brush, tree branches, palm fronds and the like that are placed for bulk collections. Green waste shall not exceed four feet in length and shall be placed in neat order parallel to the street at the appropriate bulk collection points on the designated collection days.

HAZARDOUS WASTE, DANGEROUS REFUSE means any potentially flammable items, medical waste, explosives, radioactive materials, hazardous or toxic substances, mixture, article, material or waste or related materials, including any substances defined as or included in the definition of hazardous substances, hazardous waste, hazardous materials or toxic substances, now or subsequently regulated under any applicable Federal, State or local laws or regulations, including without limitation petroleum-based products, paints, solvents, lead, cyanide, DDT, printing inks, acids, pesticides, ammonia compounds and other chemical products, compound, mixture, substance or article, asbestos, PCBs and similar compounds, marijuana byproducts and associated waste produced by a marijuana establishment or dispensary, and including any different products and materials which are subsequently found to have adverse effects on the environment and health and safety of persons. This definition shall include anything defined or designated as hazardous by the United States Environmental Protection Agency or other applicable Federal, State or local law or regulations. Hazardous waste shall not be disposed of in City containers or placed curbside for collection and will not be collected by the City.

INHABIT means to live or dwell in any structure required to have a utility account on a temporary or permanent basis.

LITTER means any rubbish, trash, weeds, green waste or debris and shall include all putrescible and nonputrescible solid wastes, including but not limited to garbage, trash, ashes, street cleanings, dead animals, abandoned automobiles, mattresses, couches, appliances, solid market and industrial waste; any deposit, accumulation, pile or heap of brush, grass, debris, weeds, cans, cloth, paper, wood, rubbish or other unsightly or unsanitary matter of any kind whatsoever; and any growth of weeds, brush, grass or other vegetable growth to a height of over six inches. Any debris created during any construction shall be considered litter for purposes of this chapter.

MULTI-FAMILY RESIDENTIAL ACCOUNT means an account for a multi-family residential dwelling unit which has requested and receives sanitation service from the City using containers designed to service more than one dwelling unit.

MULTI-FAMILY RESIDENTIAL DWELLING UNITS means any residential property comprised of two or more dwelling units, including duplexes, apartments and condominiums.

NON-RECYCLABLE MATERIALS include but are not limited to garbage, hazardous materials and medical waste; plastic bags; film or sheeting; any plastic not made from PETE or HDPE; any organic material other than acceptable paper, newsprint, cardboard, and chipboard; contaminated materials and any other trash which, at the Director’s discretion, is deemed unacceptable. OCCUPANT means a person, persons or legal entity that, through rights of ownership, tenancy or other legal means, has possession or the use of the subject real property.

PERSON means any enterprise, individual, partnership, co-partnership, firm, company, corporation, association, trust, estate, governmental entity, municipality, State or Federal agency or any other legal entity; or their legal representatives, property managers, agents, assigns, or employee thereof.

PRIVATE PROPERTY means any real or personal property which is privately owned.

PROPERTY means buildings, ground, lots, tracts of land, or other real property whether publicly or privately owned.

PROPERTY OWNER means any person, with reference to real property, that holds or has any of the following: (A) fee title, (B) equitable title, (C) any possessory right, (D) the right to occupy the premises, or (E) the right to lease, sublease or authorize another to occupy the premises for real property located in the City of Goodyear. A person is presumed to be a property owner if identified as such on any of the following: a deed, contract, lease agreement, sales agreement, the Maricopa County Recorder’s Office, Maricopa County Assessor’s Office and/or any other public record system wherein these records may be located.

PUBLIC PLACE means any and all streets, sidewalks, boulevards, alleys or other public ways and any and all public parks, squares, spaces, grounds, buildings, facilities or other real or personal property which are publicly owned.

PUTRESCIBLE means solid waste that contains organic matter capable of being decomposed by microorganisms and of such a character and proportion as to cause obnoxious odors and to be capable of attracting or providing food for birds or animals.

RECYCLABLE MATERIALS means clean and dry: paper, cardboard, chipboard, plastic containers made from polyethylene terephthalate ("PETE") or high density polyethylene ("HDPE"), polyvinyl chloride (PVC), low density polyethylene (LDPE), polypropylene (PP), polystyrene (PS), steel food cans, aluminum cans, disposable aluminum bake ware and aluminum foil. RECYCLING means the removal of recyclable materials, such as plastic, paper, glass and aluminum cans, from the waste stream and placing them back in product manufacturing.

RECYCLING CONTAINER means a container provided by the City for the disposal of items that meet the definition of recycling.

REFUSE means all solid waste, garbage, trash, litter, green waste and debris.

REFUSE CONTAINER means a container provided by the City for the disposal of items that meet the definition of refuse.

REFUSE TRANSPORTER means non-City owned vehicles used for collection and transportation of garbage, or refuse containing garbage.

RESIDENT means any person that lives full or part time within the City limits.

RESIDENTIAL CONTAINER means a receptacle of various sizes designed in accordance with City standards for use with an automated solid waste and recyclable materials program, which is provided by the City and assigned to the customer’s address at the time of account activation.

SINGLE FAMILY RESIDENCE means a single family detached dwelling.

SINGLE FAMILY RESIDENTIAL ACCOUNT means an account for a single family detached dwelling which receives sanitation services from the City using residential containers provided by the City.

STRUCTURE means buildings, improvements and other structures that are constructed or placed on land.

TRAFFICWAY means any land way open to the public as a matter of right or custom for moving persons or property from one place to another. A trafficway’s boundaries are from property line to property line and include the roadside, roadways (travel lanes), medians, separators, shoulders and alley.

UNCONTAINED BULK REFUSE means items that cannot be bagged or otherwise placed inside a refuse or recycling container.

UTILITY ACCOUNT means all accounts with the City of Goodyear for sanitation, sewer and/or water when provided by the City.
