(A) The following are illustrative of the reserved rights of Management and are not to be construed as being all-inclusive.

City Management will maintain the right to determine the purpose of each of its departments, agencies, boards and commissions, and set standards of service to be offered to the public and shall exercise complete control and discretion over its organization and operations consistent with the City Charter, City Code and City Personnel Policies and Guidelines. For example,

(1) The City will direct its employees, take disciplinary action, relieve its employees from duty because of lack of work, budgetary constraints, disciplinary reasons, or for other legitimate reasons.

(2) The City will determine whether goods and services shall be produced or provided by City employees, purchased or contracted for, and determine the methods, means, and personnel by which the City’s operations are to be conducted.

(3) The City may alter, combine, or cease any department, operation or service, and may move or interchange equipment, functions and operations between its departments or facilities.

(4) The City Manager or designee may, but is not obligated to, consult with the City’s employees, or their authorized representatives, about the direct consequences that decisions on any of the foregoing matters may have on wages, hours, and working conditions.

(5) The City will determine the overall goals, objectives and policies affecting City programs.

(6) The City will determine the size of the City’s workforce, its organization, reduction, functions, duties, amount of supervision, and table of organization.

(7) The City will direct, appoint, employ and assign officers, agents and employees of the City and determine the standards therefore.

(8) The City will determine the location of City facilities, including the establishment or relocation of buildings, divisions or subdivisions thereof, and the relocation or closing of offices, departments, divisions or subdivisions, buildings or other facilities.

(9) The City will decide the need for, and will select and acquire, all machinery, equipment, tools, components, supplies and materials.

(10) The City will determine the financial policies, including all accounting procedures and all matters pertaining to finance.

(11) The City will direct, supervise, control and evaluate the departments, units, programs, functions and services of the City.

(12) The City will classify or reclassify the various positions of the City, add or combine classifications, develop and determine levels of staffing and training, prescribe duties and standards of productivity therefore, and adopt personnel policies and guidelines, and administer the adopted merit system for eligible employees.

(13) The City will establish job requirements, job content, and the extent and nature of the work to be performed.

(14) The City will adopt reasonable rules and regulations concerning acceptable employee conduct, including rules and regulations concerning work, appearance and attendance standards, health and safety rules, policies pertaining to protective measures, devices or equipment, apparel, tobacco or training, and drug and alcohol testing policies and procedures.

(15) The City will take all necessary actions to maintain uninterrupted service to the community.

(16) The City will authorize, assign and apportion overtime, including authorization for any full, temporary, part-time or contract labor.

(17) The City and City Manager’s rights are not subjugated or diminished in any way by any expressed or implied duty or obligation to Meet and Discuss/Meet and Confer.
