(A) The purpose of this chapter is to establish policies governing the management of streets, roads, highways and other rights of way for the provision of telecommunications services providers and fiber optic cable communication systems within the City. These policies provide the City with the ability to issue licenses, on a competitively neutral and non discriminatory basis, to telecommunications and fiber optic cable corporations who use city rights of way to provide telecommunications and fiber optic services, except in cases where state or federal law forbids establishment of a license or franchise requirement. These provisions will also allow the City to manage rights of way so as to minimize the impact and cost to Goodyear citizens, as well as minimize congestion, inconvenience, visual impact and other adverse effects from the placement of telecommunications and fiber optic services within city rights of way.

(B) Without limitation upon the rights that the City might otherwise have, the City does hereby expressly reserve the following rights, powers and authorities:

(1) To exercise its governmental powers now or hereafter to the full extent that such powers may be vested in or granted to the City;

(2) To determine any question of fact relating to the meaning, terms, obligations or other aspects of this chapter;

(3) To grant multiple, nonexclusive licenses, franchises or permits within the City to other persons for the operation of telecommunication systems and fiber optic communication systems. (Prior Code, § 22-1-1)
