(A) Administrative Fines for violations of any provision of this chapter; a wastewater discharge permit or compliance order; or any other pretreatment standard or requirement may be assessed by the Director. Each day that a violation continues may constitute a separate violation.

(B) When determining the amount of an Administrative Fine, other factors including, but not limited to, compliance history, good faith by the User, nature and type of violation, and history of the User may be taken into account, as well as any economic benefit resulting from the violation, the economic impact of the penalty on the violator, and the severity of the violation. See Table under Enforcement Response Guide, Section 12A-8-18, for administrative fines that may be assessed based on the type and nature of the violation.

(C) Administrative fines differ from civil penalties in that they do not require court intervention unless the User contests the action or refuses to pay the fine. Administrative fines are punitive in nature and may not be related to a specific cost incurred by the City. Legal authority for administrative fines has been established in the Goodyear Sewer Use Chapter. The Director or his/her designee has the authority to assess fines at any time.
