(A) If Director or their designee has been refused access to a building, structure, or property, or any part thereof, and is able to demonstrate probable cause to believe that there may be a violation of this chapter, or that there is a need to inspect and/or sample as part of a routine inspection and sampling program of the City designed to verify compliance with this chapter or any permit or order issued hereunder, or to protect the overall public health, safety and welfare of the community, the Director may seek issuance of an administrative search warrant from the Goodyear Municipal Court or other court of competent jurisdiction. Such warrant shall be served at reasonable hours by the Director or designee in the company of a uniformed police officer.

(B) Nothing in this section is intended to preclude the issuance of a criminal warrant in lieu of or in addition to a civil administrative warrant to conduct a criminal investigation of a violation of this chapter or any other lawful purpose.

(C) A warrant shall be executed and returned to the magistrate/judge who issued it within 10 days after its date. After the expiration of that time, the warrant shall unless executed be void. (Ord. 14-1290, passed 3-3-2014; Am. Ord. 23-1584, passed 9-25-2023)
