§ 12A-4-9 Wastewater discharge permit transfer.

(A) Wastewater Discharge Permits may be transferred to a new owner and/or operator only if the Permittee gives at least 90 days advance notice to the Director and the Director approves the Wastewater Discharge Permit Transfer. The notice to the Director must include a written certification by the new owner and/or operator which:
(1) States that the new owner and/or operator has no immediate intent to change the facility’s operations and process;
(2) Identifies the specific date on which the transfer is to occur; and
(B) Failure to provide 90 day notice of a transfer renders the Wastewater Discharge Permit voidable as of the date to facility transfer. (Ord. 14-1290, passed 3-3-2014; Am. Ord. 23-1584, passed 9-25-2023)
