(A) Any person, including the User, may appeal to the Director to reconsider the terms of a wastewater discharge permit within 20 business days of its issuance.

(1) Failure to submit an appeal within 20 business days of the issuance of the discharge permit will constitute a waiver of the right to petition for review.

(2) In the petition, the appealing party must identify the wastewater discharge permit provisions objected to, the basis for this objection, and the alternative condition, if any, it seeks to place in the wastewater discharge permit.

(3) The effectiveness of the wastewater discharge permit shall not be stayed pending an appeal.

(4) Upon receipt of a petition for review, the Director has 30 calendar days to respond to the petition and may modify, revoke, or affirm the wastewater discharge permit in whole or part. If the Director fails to act within 30 calendar days from receipt of the petition, the petition will be deemed to be denied. The Director’s decision, including all denials, shall be considered final administrative action for purposes of judicial review. (Ord. 14-1290, passed 3-3-2014; Am. Ord. 23-1584, passed 9-25-2023)
