(A) The City is authorized to establish local limits pursuant to 40 CFR § 403.5(c).

(B) All persons owning or operating facilities or engaged in activities that will or may reasonably be expected to result in pollutants entering the City sanitary sewer system or affecting the sanitary sewer system or affecting the POTW shall undertake all practicable best management practices identified by the Director to minimize the discharge of pollutants. Such measures shall include the requirements imposed by this chapter, any applicable NPDES or AZPDES permits, and any written guidelines promulgated for general use by the Director.

(C) The Director shall have the authority to:

(1) Establish limitations for industrial users for various pollutants, materials, waters, or wastes that can be accepted into the sanitary sewer system;

(2) Specify those pollutants, materials, waters, or wastes that are prohibited from entering the sanitary sewer system;

(3) Identify those pollutants, materials, waters, or wastes that shall be controlled with best management practices; and

(4) Require industrial users or classes of users to implement best management practices for any pollutant.

(D) All affected industrial users or classes of users shall comply with the prohibitions and effluent limitations established pursuant to this article, and with any best management practices required by the Director.

(E) All prohibitions and effluent limitations so established and all best management practices identified by the Director will be placed on file with the City Clerk and become effective and enforceable on the 31st day after the date of filing.

(F) The following pollutant concentration limitations are established to protect the POTW against pass through and interference. Each User who discharges an indirect discharge to the POTW and is required to obtain a Wastewater Discharge Permit pursuant to Article 12A-4 of this chapter shall not discharge or cause to be discharged at any entry point to the POTW any wastewater containing in excess of the following daily maximum limits as set forth below:

(1)All concentrations for metallic substances are for total metals unless indicated otherwise.

(2)The Director may impose or allow mass limitations in addition to or in place of the concentration-based limitations above.

(3)The Director is authorized to calculate User-Specific Limits based on available capacity of the POTW served by the Industrial User on a case-by-case situation based on factors such as User flows, pollutant discharge levels, POTW performance, and regulatory controls imposed upon the POTW.

The above limits apply at the point where the wastewater is discharged to the POTW. All concentrations are expressed in the "total" form unless indicated otherwise. The Director may impose mass limitations in addition to, or in place of, the concentration-based limitations above. The Director may incorporate local limits on a user-specified basis into wastewater discharge permits where necessary to meet maximum allowable industrial loading limitations. Any violation of a user-specific pollutant limitation as may be set forth by the city shall subject the user to the same administrative actions, penalties, and enforcement actions as would be available for any other violations of these regulations.

(G) When the Director determines that a user is discharging to the POTW any wastes not previously identified as prohibited in such amounts as may interfere with, pass through, or upset the operation of the POTW, the Director shall:

(1) Advise the user of the impact of the contribution on the POTW;

(2) Develop a discharge limitation for such user to correct the interference with the POTW; and

(3) Require the user to comply with the discharge limits.

(H) User Specific Limits.

(1) The Director is authorized to calculate User-Specific Limits based on available capacity of the treatment plant served by the Industrial user.

(2) Available capacity is affected by several factors such as Industrial user flows, pollutant discharge levels, POTW performance, and regulatory controls imposed upon the POTW.

(3) The Director may develop Best Management Practices (BMPs), by chapter or in individual wastewater discharge permits to implement Local Limits and the requirements of Article 12A-2.

The following Pollutants may be incorporated into the WDP by the Director as User Specific Limitations or as Alert Levels:
